Sebastian Szulkowski is an English lawyer specializing in matters relating to English civil law.
He is a practitioner in matters with international element, at the juncture of jurisdictions; in particular in ‘common law’ countries (i.e. England / United States, Canada) and Poland.
Sebastian has been working in the UK (London) law firms for over 13 years; he currently advises our Clients in cases with international element.
COMMERCIAL LAW – CRIMINAL / ENGLISH CIVIL PROCEDURE
A (Sweden) -v- S (Poland) – High Court of Appeal in London (United Kingdom)
Member of the legal team in a case concerning the interpretation of the right to be sued before an English court and intellectual property law issues, before the High Court (Chancery Division, High Court), and then before the Court of Appeal in London.
The Court of Appeal in London declared the action against the Clients inadmissible. The case has set an important precedent for international disputes in the UK, developing the so-called “relevance test” for cross-border employment and intellectual property law disputes.
D N. Ltd. -v- S C (POLSKA)
Advising and representing (together with Polish lawyers) in a case of so called “large-scale theft” to the detriment of a UK based transportation firm.
Before the Polish court, together with the Polish lawyers, secured conviction of a criminal, who stole PLN 1.3 million, and a compulsory prison sentence.
He obtained numerous security applications against property of the offender and a judgment where court ordered complete compensation.
H Ltd (Hong Kong) -v- B. (Bank) Plc. (UNITED KINGDOM)
He advised a Hong Kong-based company on the civil liability of an English bank for improper execution of their client’s transfer instructions.
The English bank questioned the erroneous transfer, but after his intervention, the customer received a refund of the entire amount of the transfer.
The client avoided a large financial penalty, a court sentence, and a criminal record.
KP Sarl and ZZ -v- B. (Bank) Plc. (UNITED KINGDOM / POLAND / FRANCE)
He obtained two orders to waive banking secrecy and disclose information in which two London banks were defendants.
The bank’s accounts were used to commit a crime (m.in money laundering and economic crimes to the detriment of a French and Polish companies).
Both proceedings were fully contested by the bank’s legal representatives on the grounds that the disclosure of documents was inadmissible for the purposes of proceedings conducted in other countries.
ENFORCEMENT OF JUDGMENTS
DD -v- PA (UNITED KINGDOM)
He acted on behalf of a client in a case concerning the disputed enforcement of a judgment obtained in the District Court in Barnet (London).
Mr. Szulkowski obtained security on the defendant’s bank accounts, real estate and property.
He also led to the discontinuance of the proceedings in the Court of Appeal in London, due to the inadmissibility of the opponent’s allegations and procedural errors.
PP -v- FA (UK/US)
For his client, Mr Szulkowski secured a ruling at the Court at Willesden (London), and then together with lawyers from the USA obtained security on a property located in Chicago, USA. The property of our client’s opponent had to be sold due to the high sum obtained in court proceedings.
NON-CONTENTIOUS MATTERS
Case of C. from Krakow (non-contentious case)
Mr. Szulkowski introduced one of the largest software producers based in Poland, and subsequently advised them on English contract and property law.
Contracts based on English law
For his Client, a Poland based company operating in Food and Beverages sector, Mr Szulkowski created and implemented new business model enabling operations under English law and subsequently and also international expansion.
For his Client operating in the construction industry, based in London, created commercial Terms and Conditions to enable importation specialized building materials from the United States.
