Buying or selling property in Poland (private or commercial)

It is trite to say that purchase of property, investments, leases or rental agreements can carry considerable financial risk that can and should be considered and managed. In any transaction involving significant amounts of money, it is in your best interest to seek competent advice on the legal aspects of the transaction. In our experience, this is more honored in the breach than the observance.

Purchase or sale of property in Poland is usually associated with the involvement of one lawyer (a Public Notary) acting for both sides of the transaction. Solicitors or Advocates, in the process of buying, selling or renting properties in Poland may assist you in checking and advising on the legal status of the property (due diligence), analyzing the notarial deed and proposing changes. We act as your independent advisors and will typically be involved in the following:

  • preparing collateral agreements or guarantees in the process of buying or selling property;
  • providing advice and assistance in relation to any disputes regarding the property;
  • preparing preliminary, conditional, and ‘reservation’ agreements for properties in Poland;

In the case of a one-off assignment, such as providing an opinion on a contract, proposing changes to a notarial deed, our costs are usually fixed. We charge for specified work we will do. Our fees start from the 1,500.00 PLN + VAT, for the first few hours of our work (that is approx. 320 Eur / US Dollars). The details and scope are agreed individually with each Client.
