Succession, succession and administration of the estate in Poland

Inheritance cases are integral part of our law firm’s business. We have been advising on inheritance matters since the beginning of its operation.

Clients usually engage us in matters concerning so called ‘acquisition of inheritance’, assistance in matters regarding the division of inheritance assets, as well as some (but very limited) assistance in drawing up wills and making bequests.

Our experience also includes litigation (including criminal and civil proceedings) related to inheritance (i.e. forgery of wills, disinheritance, and so called ‘reserved share’ cases), cross-border inheritance disputes between parties living in different countries.

Our costs are calculated based on the complexity of the task, and the level of responsibility we are asked to assume. For a one-off task, such as providing legal advice or an application to the court, fees are usually fixed and presented before you engage our services. Our fees start from 1,500 + VAT PLN (that is approx. 320 Eur / US Dollars), for the first few hours of our work (details and scope are agreed individually with each client).

In the case where the end cannot be precisely determined (e.g. matters where an end cannot be precisely determined), we use either hourly rates or staged system of fees, where we ask you to pay for the step we endeavor to take. This allows you to control costs and make decisions that are controllable. You do not pay large costs in advance, but gradually, which allows you to take into account the expenses for legal services.

Below you will find information on some of the most interesting inheritance cases in which we have been involved so far.

  • We represented a client in a case concerning forgery of a will, in which we caused the charges of forgery to be dropped; as a result, our client, in a long court battle, was entitled to a possession of the property of her long-term partner, who died many years ago;
  • We represented a group of 32 heirs in a cross-border succession case of a deceased person in the UK;
  • We advised on a case concerning the management of the inheritance of a Polish citizen living in Australia (Brisbane); its estate included 17 properties in East Poland.

Please note that above summary is not intended to be a substitute for a professional legal advice relating to inheritance law. This is solely information about our services.

The results we have achieved in these cases may not be representative and may not always be the same as those achieved in your individual case.
