Arkadiusz Charążka represents Clients in civil and criminal cases.

He has advised and actively represented individual Clients in cases related to fraud, drug smuggling, extortion, murder. For businesses he represented Clients in cases involving tax avoidance, smuggling of goods and business crime.

He specializes in extradition, deportation and ‘white collar crimes’. He has extensive experience in cases that end up in Appeal Courts or in the Supreme Court.

He also acted as Of counsel to foreign law firms (Russia, Great Britain, Ireland, Germany). A significant part of Arkadiusz’s cases is widely commented on in the media.

FRAUDS

  • Acted as prosecution for a UK based transport company, where court convicted a criminal in a fraud case worth over PLN 1.3 million. Court delivered sentence of compulsory imprisonment. He obtained numerous securities on the convicted person’s property and a compensatory order.
  • He was acting behalf of a bank employee in a bank fraud, successfully changed initial classification of an offence, that allowed dismissal of the case at the court.

EXTRADITION

  • Arkadiusz was acting on behalf of a Polish Client living in the Netherlands. According to the Polish prosecutor, the client committed the crime of drug trafficking in Poland. Arkadiusz led to the declaration of dismissal of the European Arrest Warrant, due to the conflict of law principles. As a result, our client was not extradited from The Netherlands.
  • Acting as a of counsel of a UK law firm, he represented three Clients convicted in Poland of minor business crimes. He had secured dismissal of the extradition order, due to the ‘triviality’ points. Clients were not removed from the UK. Clients were requested to repair damage they have caused in Poland.
  • Arkadiusz acted on behalf of a Polish businessman residing in Russian Federation, in the extradition case in Poland. Our view was that the client was unjustly extradited from the Russian Federation. The court shared our view. Arkadiusz won a positive judgment for his client in the Supreme Court, concerning the right to compensation for unjust arrest and extradition.
  • Arkadiusz was acting on behalf of a Polish Client, domiciled in Ireland, charged with drug trafficking at a pre-trial investigation stage, in Poland. Arkadiusz secured termination of the proceedings due lack of credible grounds for committing the crime, as well as errors in criminal procedure in Poland.
  • Arkadiusz acted in extradition case of a Polish citizen, at the request of German court. The extradition was suspended initially, due to other ongoing proceedings against the client in Poland. Then, together with German lawyers, he assisted in securing voluntary submission to the punishment on the terms indicated by the defense in Germany (the client, as a consequence, and in accordance with German law, spent the judgment working at a hospital).

TAX OFFENCES

  • Arkadiusz was acting for a car dealer in Poland, in a tax avoidance and trade offences matters, in Poland. The Court of Appeal upheld the acquittal.
  • At the request of the Director of a of a company, he secured acquittal in a tax avoidance case involving 2 million zlotys. He led to obtaining in the administrative court the annulment of the tax decision, and then to the acquittal of the client in the Court. The prosecutor’s office did not appeal.
  • In the tax avoidance matter, Client spent 9 months in custody as a pre-trial detainee. The charges against him were found to be insufficient to convict his Client. Arkadiusz led to the acquittal of the client, due to procedural errors and the statute of limitations, for criminal offences. The client received PLN 130,000 in compensation for unjust arrest.

BUSINESS LAW

  • Arkadiusz acted in the case of shoe dealers from Nigeria, who were charged with the intellectual property offences. He secured acquittal of the Clients, due to lack of ‘unintentionality of the offences’ under Polish criminal code.
  • In the Supreme Court –he had secured the favorable judgment to his client, in the case concerning the limitation point, in the civil law claim. Two court rulings were overturned as a result. He had prevented execution against the client’s property.
  • In the bankruptcy case, he secured annulment of creditors’ liabilities in the amount of approx. PLN 800,000. The bankrupt, as a result, was discharged from the liabilities.
