Family law in Poland

Family disagreements can be quite complex, frustrating and sensitive for both parents and the children. They very often have far-reaching consequences for the families; especially for children whose rights may be violated by the decisions of the adults.

Choosing experienced lawyer, is only part of the job. Knowing whether he knows his craft, whether he will not be avoiding you and will have a good customer set of skills – is another. For those of you who want to end the dispute quickly and without exposing to large financial burdens, we always suggest alternative methods of dispute resolution (negotiation or mediation) which can bring a settlement, without going to court.

Family settlement proceedings require approach aimed at solving the problem, not escalating it; we want to bring you a the long-awaited solution if possible, in warm atmosphere.

Our standard services in this field may include

  • we act in all types of divorce cases (contentious and non-contentious) including cases with international element;
  • dealing with property division matters – we represent in proceedings related to division of matrimonial assets, and enforcement of decisions already made by relevant authorities or the court;
  • children custody matters in Poland – we represent Clients in cases of contact, alimony (/child maintenance), international child abductions, temporary and permanent variations in children residence arrangements (including international relocation of the children);
  • domestic violence cases;
  • in cases where there is a requirement for specific court’s order– e.g. in the event that the spouse, does not want to agree to specialist treatment of the child, does not want to agree to trip abroad with the child, intentionally remains unemployed;

We cooperate with individual Clients, but also with public State Agencies (Polish and foreign) that need specialized services related to family law; In many cases, we work with psychologists who help us assess the needs and fears of the other side of the conflict.

In some family law cases in Poland, it may be possible to obtain free legal aid and representation at the court. Regrettably, our firm does not offer any assistance to those Clients who may otherwise qualify for a lawyer, paid for by the State. You may also contact local ORA (Advocates’ Regulatory Body in Poland) or OiRP (Solicitors Regulatory Authority in Poland) for further details how to appoint state lawyer in Poland, or ask the court for granting you lawyer in a written application to the court (usually made at the commencement of your case).

Our costs are calculated based on the complexity of the task, and the level of responsibility we are asked to assume. Please contact us for information on costs.

For a one-off task, such as providing legal advice or an application to the court, fees are usually fixed and presented before you engage our services. Our fees usually start from1,500.00 PLN + VAT, for the first few hours of our work (this is around 320 Eur / US dollars. Details and scope are determined individually with each client.

In the case where the end cannot be precisely determined (e.g. matters where an end cannot be precisely determined), we use either hourly rates or staged system of fees, where we ask you to pay for the step we endeavor to take. This allows you to control costs and allow you to make informed decisions. You do not pay large costs in advance, but gradually, which allows you to include expenses for legal services in your home budget.

  • in partnership with an UK based law firm, we advised and represented a client (a Polish citizen residing in the United Kingdom) in a divorce case concerning the territorial jurisdiction of a court in Poland.

Our client wanted the case to be tried before a British court due to the solution regarding the division of property. We acted with a law firm in the UK, as the proceedings were almost parallelly pending in the courts of two countries. As a result of our intervention, the District Court in Poland found that it has no jurisdiction to deal with the dispute, and the case was resolved, to our Clients favor, in the court in London;

  • we have advised London Borough of Lambeth on the recognition of decisions of British courts in Poland in the case of the custody of children.
